Tobacco and Vapes Bill legislative consent in Wales - consultation response

In January 2025, we responded to the Senedd Health and Social Care Committee's call for comments as part of its scrutiny of Legislative Consent Memoranda relating to the Tobacco and Vapes Bill.

Our response

Whilst the Tobacco and Vapes Bill has been developed by the UK Government, the devolved governments in Northern Ireland, Scotland and Wales all support its ambition to eradicate smoking and to tackle vaping amongst young people. Collaboration between the four governments across the UK on development of the Bill has therefore been strong and sustained. 

As the legislation will apply in Wales but relates to devolved responsibilities, it is subject to the 'legislative consent process' - this means that the consent of the Senedd (Welsh Parliament) is sought by the UK Government to legislate on an issue that falls within its remit. 

The Senedd's Health and Social Care Committee has scrutinised the Bill and related Legislative Consent Memoranda tabled by the Welsh Government. The Committee invited comments on the Bill and its proposed effect in Wales.

  • In our response, we outlined our strong support for the proposals which is a once in a generation opportunity to safeguard the health and wellbeing of children and young people, as well as that of future generations. 
  • We support proposals to reduce the appeal and access of vapes to young people, raise the age of sale for tobacco products and expand smokefree and vape free outdoor public places.
  • We believe these are crucial measures to help create the first smokefree generation and tackle the rise in youth vaping across the UK.
